I was looking through css-mania for some inspiration and I came across this guy's website and immediately I noticed he's ripped a lot of ideas from Elliot Jay Stocks. It's not an exact duplicate but take a look for yourselves, it's quite obvious for example the navigation, font, portfolio preview are pretty much direct dups.
Imitation is the highest form of flattery. So what if he was heavily inspired by the site? He didn't duplicate it, he just took what he liked from it and used it in his own design.
When I hear a band do a catchy but substantial pop riff, I don't immediately say "Man, these guys are just totally ripping off The Beatles."

Is there similarity? Most certainly. I don't think there's enough to warrant a straight "rip" though. Heavily inspired? Yup, double yup.
